1. Agreement to Terms
By accessing or using the Claret mobile application and related services ("Service"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Taylor Clauson d/b/a Claret AI ("Claret," "we," "us," or "our"), the operator of the Claret wine recommendation platform.
2. Description of Service
2.1 Core Service
Claret is an AI-powered wine recommendation platform that provides:
- Personalized wine suggestions through conversational AI
- Wine label and menu scanning capabilities
- Wine preference learning and taste profile development
- Wine collection management and favorites tracking (Wine Journal)
- Food pairing recommendations
2.2 AI-Powered Recommendations
All wine recommendations are generated entirely by artificial intelligence. There is no human review, sommelier oversight, or expert curation of individual recommendations. While we work to improve our AI models, recommendations are based on patterns in data and may not always match your personal taste. We do not guarantee that you will enjoy every recommended wine.
3. Account Registration and Security
3.1 Account Creation
- You must be of legal drinking age in your jurisdiction to use Claret
- You may create an account using Google Sign-In or Apple Sign-In
- You are responsible for maintaining accurate account information
- You must provide truthful information during registration
3.2 Account Security
- You are responsible for safeguarding your account credentials
- You must immediately notify us of any unauthorized use of your account
- We are not liable for losses resulting from unauthorized account access
- You may not share your account or allow others to use your account
3.3 Account Termination
- You may delete your account at any time through the app settings
- We may suspend or terminate accounts for violations of these Terms
- Upon termination, your access to the Service will end and your data will be deleted as described in our Privacy Policy
4. Subscription Plans and Billing
4.1 Free Tier ("Tasting")
The free tier includes limited access to the Service:
- 15 messages per month (all chat modes including follow-up messages)
- 3 lifetime label scans
- 1 lifetime menu scan
- 25 Wine Journal entries
- Full access to chat history and preferences
4.2 Premium Tier ("Sommelier")
The premium subscription removes all usage limits:
- Unlimited messages across all chat modes
- Unlimited label scans
- Unlimited menu scans
- Unlimited Wine Journal entries
4.3 Founder Tier
Founder-tier subscribers receive the same unlimited access as Premium subscribers.
4.4 Billing and Payment
- All subscriptions are billed through the Apple App Store
- Available plans: Monthly ($4.99/month) or Annual ($39.99/year)
- Subscriptions automatically renew unless cancelled before the end of the current billing period
- Payment is charged to your Apple ID account at confirmation of purchase
4.5 Cancellation and Refunds
- You may cancel your subscription at any time through your Apple ID account settings
- Cancellation takes effect at the end of the current billing period
- Refund requests are handled per Apple's App Store refund policies
- We do not process refunds directly — all billing is managed by Apple
4.6 Price Changes
- We may change subscription pricing with reasonable notice
- Price changes will not affect your current billing period
- Continued subscription after a price change constitutes acceptance of the new price
5. Acceptable Use Policy
5.1 Permitted Uses
You may use Claret for:
- Personal wine discovery and recommendations
- Educational purposes related to wine and food pairing
- Managing your personal wine collection and preferences
5.2 Prohibited Uses
You may not use Claret for:
- Commercial wine sales or business operations without our written consent
- Attempts to reverse engineer, decompile, or extract our recommendation algorithms
- Uploading inappropriate, offensive, or copyrighted content
- Creating multiple accounts to circumvent usage limitations
- Automated access, scraping, or data mining of our Service
- Violating any applicable laws or regulations
5.3 Content Guidelines
When using chat features or uploading images:
- Content must be relevant to wine, food, or dining
- No harassment, threats, or abusive language
- No spam, promotional content, or commercial solicitations
- Respect intellectual property rights in uploaded images
6. Intellectual Property Rights
6.1 Claret's Intellectual Property
- The Claret app, algorithms, and recommendation engine are our proprietary technology
- Claret trademarks, logos, and branding are our exclusive property
- You receive a limited, non-exclusive license to use the app for personal purposes only
6.2 User-Generated Content
- You retain ownership of personal notes, ratings, and comments you create
- You grant us a license to use your content to improve the Service and provide recommendations
- You represent that you have the right to upload any images or content you share
- We may remove content that violates these Terms or applicable laws
6.3 Wine Label and Menu Images
- Images you scan are used for recognition and recommendation purposes
- We respect intellectual property rights in wine labels and restaurant menus
- Images are stored as needed for service functionality (label analysis, menu caching)
7. Third-Party Wine Purchases
7.1 Retailer Links
- Claret may provide links to wine retailers and online stores for your convenience
- We are not responsible for the quality, accuracy, or availability of wines from third-party sellers
- Purchase transactions are between you and the retailer, not Claret
- We do not handle payments, shipping, or customer service for wine purchases
7.2 Price Information
- Wine prices shown in the app are estimates and may not reflect current retail prices
- Prices may vary by location, retailer, and time
- We are not responsible for price discrepancies or changes
- Final pricing is determined by the retailer at the time of purchase
8. AI and Machine Learning Disclosures
8.1 AI-Generated Content
- All wine recommendations are generated using artificial intelligence models (OpenAI and/or Anthropic)
- AI responses may contain errors, inaccuracies, or inconsistencies
- Recommendations are based on data patterns and may not account for all factors
- No human sommeliers or wine experts review individual AI recommendations
- We continuously work to improve AI accuracy but cannot guarantee perfection
8.2 Learning and Personalization
- Our algorithms learn from your preferences, ratings, and feedback to build a taste profile
- Personalization improves over time with continued use
- You can update your preferences at any time through the app
- You can delete your account to remove all learned data
9. Privacy and Data Protection
9.1 Privacy Policy Integration
- Your privacy is protected according to our Privacy Policy, which is incorporated into these Terms
- Data collection and use practices are detailed in the Privacy Policy
- By using Claret, you consent to data processing as described in our Privacy Policy
9.2 Data Security
- We implement security measures to protect your data, including TLS encryption and Row Level Security
- Chat histories and recommendations are protected against unauthorized access
- Security incidents will be reported as required by applicable laws
10. Disclaimers and Limitations of Liability
10.1 Service Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee:
- Uninterrupted or error-free service
- Accuracy, completeness, or reliability of wine recommendations
- Availability or compatibility of third-party integrations
10.2 Wine-Related Disclaimers
- Wine recommendations do not constitute professional sommelier advice
- Individual taste preferences may vary significantly from AI recommendations
- We are not responsible for allergic reactions or health issues related to recommended wines
- Alcohol consumption should be done responsibly and in accordance with local laws
- Claret does not sell, serve, or deliver alcohol
10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability for any claims related to the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- We are not responsible for losses resulting from third-party wine purchases
- These limitations apply regardless of the theory of liability
11. Apple App Store Terms
11.1 App Store Compliance
- Your use of Claret through the Apple App Store is subject to Apple's Terms and Conditions
- Apple is not responsible for Claret's functionality or content
- Apple has no obligation to provide maintenance or support for Claret
- Apple is not liable for any claims related to Claret
11.2 Subscriptions
- Subscriptions are managed through the Apple App Store
- Apple's policies govern all in-app purchase transactions
- Subscription management is handled through your Apple ID account settings
12. Geographic Restrictions and Legal Compliance
12.1 Age Restrictions
- Users must be of legal drinking age in their jurisdiction
- We do not provide services to minors
- Parental controls should be used to restrict minor access to wine-related content
12.2 International Use
- Claret may not be available in all countries
- Wine recommendations are based primarily on wines available in supported markets
- Local laws regarding alcohol information and recommendations must be followed
- Users must comply with all applicable local, state, and federal laws
13. Modifications to Terms and Service
13.1 Terms Updates
- These Terms may be modified at any time with notice to users
- Material changes will be communicated through the app
- Continued use after changes constitutes acceptance of modified Terms
- Users who disagree with changes may terminate their accounts
13.2 Service Changes
- We may modify, suspend, or discontinue features at any time
- Significant service modifications will be communicated with reasonable notice
- Free tier limits may change; existing paid subscribers will not lose access to features included in their plan
14. Dispute Resolution and Governing Law
14.1 Governing Law
- These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles
- Disputes will be resolved in the courts located in the State of Kansas
14.2 Dispute Resolution Process
- Direct Communication: Contact us first to resolve issues informally
- Mediation: If needed, disputes may be resolved through mediation
- Arbitration: Binding arbitration may be required for certain disputes as permitted by law
- Class Action Waiver: To the extent permitted by law, users agree to resolve disputes individually, not as part of class actions
14.3 Exceptions to Arbitration
The following disputes are exempt from mandatory arbitration:
- Intellectual property disputes
- Small claims court matters within jurisdictional limits
- Emergency injunctive relief requests
15. Termination
15.1 User Termination Rights
- You may terminate your account and stop using Claret at any time
- Account deletion can be performed through the app settings
- Data deletion is immediate and permanent as described in our Privacy Policy
15.2 Claret Termination Rights
We may terminate or suspend your access if you:
- Violate these Terms of Service
- Engage in fraudulent or illegal activities
- Abuse the Service or attempt to circumvent usage limitations
- Provide false information during registration
15.3 Effect of Termination
Upon termination:
- Your access to the Service ends immediately
- Personal data is deleted as described in our Privacy Policy
- Active subscriptions should be cancelled through Apple to avoid further charges
- These Terms survive termination where necessary to enforce our respective rights

17. Miscellaneous Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Claret regarding the Service.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
17.3 Assignment
You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor entity.
17.4 Waiver
Our failure to enforce any provision does not constitute a waiver of our right to enforce that provision in the future.
17.5 Force Majeure
Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, government actions, or third-party service outages.
